    After much negotiation (and incredible patience on your part) we are pleased to announce that Abracadabra! The Magic of YPO at Disney has been rescheduled to 18 May 2022.

    We have worked extensively with Disney, Universal and Cirque to come to a preliminary agreement to postpone the event.  Because you were patient, we believe we were able to eliminate substantially all of the contractual liability to which we were exposed and recover substantially all of the funds we had expended.

    This effort is expected to save guests and membership more than $1 million.

    While we know that the obtuseness of our communications might have left you wondering what we were thinking, it allowed us the time and leverage to negotiate a great outcome.

    We will be working this week and next to finalize the documentation of our agreements with each company.

    When those documents are complete, we will work with Disney to process the cancellation of all hotel reservations and the refund of all hotel deposits.

    If you have made travel arrangements, you are free to cancel those now.

    Because your registration status is active on 01 April 2020, you will have two options with regard to your event registration.

    • First, you’re automatically registered for the new dates — no additional action is required.  Your registration fees will remain on account and will be applied to the 2022 fees when they are set.  Best of all, you will receive a discount of 10% off the 2022 fees!  This discount could save your family a substantial amount and is one way to thank you for your patience.
    • Alternatively, you may request a cancellation of your registration and a refund of your registration fees.  While this would make us sad, simply send an email after 13 April to concierge@magicofypo.org instructing us to cancel your event registration.

    We had such an awesome event planned for 2020 and we are so disappointed that we won’t be able to greet you as hoped.

    But it means that it will be a great journey in 2022 when Abracadabra! returns for its 8th installment!

    This week has been full of activity for the Magic of YPO executive cast.

    There has been little news from Disney or Universal.  Disney did not release employee schedules as they would normally have done and nobody expects that they will open as promised on 01 April 2020.

    Cirque has furloughed (or fired) almost all of their employees including cast members in Disney’s Drawn to Life production that was schedule to preview on 20 March.

    We have been meeting with counsel to discuss our strategy to protect our exposures and recover our expenditures.

    So we can share the same information this week that we shared last week.

    • Our financial exposure remains the same as it was before.
    • Much of that exposure is covered by force majeure provisions that may or may not be operable under today’s circumstances.  If they are not operable today, they likely will be shortly given trends in social distancing around the world.
    • When we assert force majeure, a failure to performance under contract will not be a breach and we can postpone the event subject to terms satisfactory to us.
    • Do not increase your own financial exposure to the event; we are advising that you do not purchase non-refundable travel at this time.
    • Remember that your hotel reservations are cancellable at any time up to five days before the event without penalty to you; so you have time to mitigate this exposure.

    We appreciate your continued patience and exceptional tolerance of uncertainty.  We plan to have a final determination by 13 April 2020.

    In our companies and homes we are doing all we can to keep people safe, preserve resources and maintain liquidity.  It only seems reasonable to do so here as well.

    Please don’t think we are confused about the impact of COVID-19 on this program and its viability.

    In fact, our site visit in Orlando last week highlighted a number of ways in which planning by our vendors, Orange County and the State of Florida currently would not meet the standards required by our Health Safety Plan.

    Here are some examples of the ways in which companies and governments are behind the curve in their preparations:

    • Disney was requiring biometric finger scans at the gates but was not cleaning the scanning surface between guests.
    • There were no observable ride and attraction hygiene measures at Disney or Universal.
    • There were no social distancing instructions anywhere at Disney or Universal.

    More importantly, Disney was not able to describe specific plans for response to infectious disease incidents that were at all satisfactory.  Orange County’s response to inquires from our risk management team were even less satisfactory.

    But, on Thursday, the parks were full and lines were longer than 3 hours for top attractions.

    And you would think that would have been stemmed by the announcement of Disneyland and then Disney World closing.  But it wasn’t; instead even more people rushed to the parks.

    I remember exactly where I was on 09/11.

    I thought it was my Kennedy moment; the one my mom described to me as a child.  She would say, “I remember exactly where I was when I learned that Kennedy had been shot.”

    Today, I am in Orlando with Laurel and Matthew and Lea.

    We are in the second day of three days of detailed meetings focused on details that you might never recognize as important or relevant.

    But today seems like another Kennedy moment. 

    Mind you, we are not ignorant of what is happening all around us.  But, we needed to prepare for every possible scenario that presents itself including the low probability that things turn out fine and the event proceeds as planned.

    We also are here to negotiate every other possible outcome and the financial implications of each.  These range from postponing the event to, what at the beginning of the day seemed unlikely, the closing of the parks.

    But with each passing hour, another shoe fell.

    As I sit in my Sugarloaf room at 11:45pm, that seemingly unlikely scenario has come to pass and Walt Disney World will close temporarily beginning 16 March 2020.

    So tomorrow our meetings continue though with a decidedly different agenda.

    We don’t have specifics yet to share with you but please rest assured that we will continue to share details as we can.  Sometimes those may be delayed as we prioritize the work over the communication.  Some times they will come like this one, late at night and less complete than we would like.

    We are committed to update you about Magic of YPO’s Abracadabra! 2020 and the coronavirus each week on Tuesday following our weekly meetings OR as information becomes available.

    The start of Abracadabra! 2020 is still more than 60 days from today and, like all events after 08 May 2020, is being evaluated independently.

    At this time, the event will be presented as scheduled 13 May – 17 May 2020. This continues to be subject to change.

    We appreciate that the situation remains uncertain and that it continues to evolve as new facts about the virus and its spread and impact in the United States are learned.

    We also know that our guests represent a broad and diverse group with different levels of tolerance for uncertainty and risk.

    We continue to work to make thoughtful decisions that reflect both the uncertainty and the risk attendant to this event given the risks, mitigations and exposures specific to this event.

    At this time, Walt Disney World and Universal Studios remain open.

    The parks are hosting an average of almost 250,000 guest and cast members each day. Disney and Universal Studios are accustomed to health safety issues, have very detailed plans for protective and preventative actions and, as you can imagine under the circumstances, are very attentive to the training and compliance required to make those effective. We recognize that this could change too and we will evaluate should there be a change to their operations.

    At this time, our team meets regularly on this issue and it remains at the top of our agenda each week.

    As we have stated before, we continue to monitor information provided by authoritative sources including the World Health Organization, the Centers for Disease Control and the Florida Department of Health. We are also working with the Walt Disney Company, Orange County Department of Health and the Reedy Creek Improvement District to understand preparedness and response plans. And our cast is planning for additional preventative and protective actions to supplement those Disney has planned for its regular guests.

    At this time, our financial exposure for the event is substantially fixed.

    Our agreements contain liquidated damages clauses that cap our liabilities. Additional financial commitments are known and scheduled for a time far closer to the event and the timing of fulfilling those commitments is subject to further negotiation under the circumstances. Our agreements also contain force majeure provisions that would further limit our liabilities should certain circumstances physically prevent us from performing under our agreements. We are very sensitive to financial issues.

    At this time, the event will be presented as scheduled 13 May – 17 May 2020.

    We recognize that each of you will make a very personal choice about your own tolerance for uncertainty and for risk.

    And, we respect that different people may make different but thoughtful decisions.

    We are committed to update you about Magic of YPO’s Abracadabra! 2020 and the coronavirus as information becomes available.

    At this time, the event will be presented as scheduled 13 May – 17 May 2020.

    We understand that the situation continues to evolve as new facts about the virus and its spread and impact are learned.

    We continue to monitor information provided by authoritative sources including the World Health Organization, Center for Disease Control and the Florida Department of Health.

    We are also working with the Walt Disney Company, Orange County Department of Health and the Reedy Creek Improvement District to understand preparedness and response plans.

    And our cast is planning for additional preventative and protective actions to supplement those Disney has planned for its regular guests.

    Our team meets regularly and this issue is at the top of our agenda each week.

    At this time, Walt Disney World remains open and hosting an average of almost 250,000 guest and cast each day.  We recognize that this could change too and we will evaluate should there be a change their operations.
